There are a number of times when we are wronged by others and we feel we should be compensated for the same. A "tort" (tort mean a civil wrong that you can claim compensation for) is a civil wrong for which the person wronged can claim compensation from the wrong-doer. A "tort" often arises because a legal duty owed to the public is violated, and in the process an individual's rights have been violated. The law compensates the person wronged for the harm caused. The compensation is never fixed a amount and is generally determined by the Court in each case after taking into account various relevant facts. The use of the word "wrong" in the discussion should not be taken to imply that, for every grievance morally felt by an individual, the law of torts provides compensation. A legal wrong (for which compensation can be claimed) arises only if the law recognizes the act as deserving compensation. Categories... |
