Public Interest litigation

Public Interest litigation is a tool that has been devised by the Supreme Court to allow for a speedy and effective implementation of the Fundamental Rights guaranteed by the constitution. Through PIL's the courts have relaxed rules of procedure allowing individuals and organizations to file cases “In Public Interest” on behalf of

 

  1. Other persons or classes of persons whose fundamental rights are being violated and who are not in a position to approach the court. (For example this group might include prisoners, bonded labourers, persons who are victims of police abuse etc) or
  2. The general public (For example cases taken up on environment, consumer, government accountability issues etc)
